In 1942, the U.S. was invaded by foreign forces bent on destroying the U.S. military might. To day, 70 years later to-the-day, the U.S leadership has laid the ground work for the largest invasion on to the U.S. mainland by foreigners in our history.</p>
<p>“In a testimony before the Senate Committee on Finance, Treasury Secretary Timothy Geithner said he is in favor of expansion of H-1B visa programme, offered to highly skilled professionals and students to live and work in the US.”</p>

<p><a href="http://lawofficeofjamesaotto.com/home/wp-content/uploads/2011/12/Hillary.jpg"><img class="alignright size-full wp-image-120" title="Hillary" src="http://lawofficeofjamesaotto.com/home/wp-content/uploads/2011/12/Hillary.jpg" alt="" width="300" height="300" /></a>On December 7, 2011, Secretary of State Hillary Clinton, through the U.S. Embassy in India, announced that the State Department has authorized the U.S embassy to allow the admission of a limitless number of foreign workers into the U.S. to take jobs that millions of unemployed Americans could and would do.</p>

<p>The practical implications of the State Department’s conduct is that every U.S employer can now hire as many foreign workers as they desire to replace all American workers. Then, the U.S. taxpayer must pay more taxes to care for the unemployed and their children.</p>
<p>In a rear guard action, Senators, Dick Durbin (D-Ill.) and Charles Grassley (R-Iowa), are attempting to limit the harm to Americans and American jobs by proposing to limit the number of imported foreign workers to 50% of a company&#8217;s U.S. workforce, the so called 50/50 rule.</p>
<p>We should have seen it coming. In 2010 the USAID, a U.S. federal Agency that receives overall foreign policy guidance from the U.S. Secretary of State, authorized the investment of between $10 and $36 million to train several thousand Sri Lankans in advance computer software principals in order to compete with U.S. workers for U.S. jobs.</p>

<p>Similarly, the U.S. government invested an undisclosed sum in Armenia to train workers to compete with U.S. workers.</p>

<p>The U.S Government has been building up to this for several years. The U.S. Government does fully comprehend the enormity of the problem because it keeps statistics published by the Department of Homeland Security that prove the U.S. continued to admit foreign labor into the country at higher rates than the pre-2008 recession levels. Between 2001 and 2006, the average number of admitted foreign &#8220;workers and trainees&#8221; into the U.S. was only 860,000. However, these numbers increased drastically beginning in 2007:</p>
<p style="padding-left: 30px;"><strong>2007</strong>: 1,932,075<br />
<strong>2008</strong>: 1,949,695<br />
<strong>2009</strong>: 1,703,697<br />
<strong>2010</strong>: 2,816,525</p>

<p>The above numbers are quoted from the Department of Homeland Security 2010 Yearbook of Immigration Annual Statistics, table 25, page 64, and shows the number of admitted foreign persons allowed into the U.S. as &#8220;workers and trainees.&#8221; That means every admitted foreign worker or trainee was admitted on an employment visa, which required every foreign worker had to be employed by a U.S employer before entering the U.S.; thus, every foreign worker was taking jobs that either would have been available to or were already occupied by U.S. workers. In the category of &#8220;Worker and Families&#8221; that were admitted into the U.S., the numbers increase by an average of 74% per year. Because many of these families include a working spouse, the impact on US. workers and lost U.S. jobs could be as much as doubled.</p>
<p>Americans feel the disconnect between &#8220;no jobs available&#8221; and importing millions of foreign workers. Is it purely coincidental that from 2008 through 2010, 8.4 million foreign workers found U.S. based jobs, while, according to the U.S Bureau of Labor Statistic, during the same time period, the U.S. lost approximately 8.4 million jobs.</p>
<p>How can a company make record profits if it cannot afford to employ workers? Even during the current recession/depression, corporate profits skyrocketed, and, coincidentally, politicians collected millions of dollars from corporate campaign gifts.</p>

that shows a national immigration law firm conducting a training seminar to a corporate audience. Listen well. They actually state &#8220;the goal is NOT to find a qualified American worker.&#8221; The attorneys are teaching corporations the strategies to avoid hiring American workers-while they, in fact, hire cheaper foreign workers. This five minute video will anger every patriotic American.</p>
<p><strong>The segregation of Americans out of the American job market is soon to be complete.</strong> There are &#8220;foreigners only&#8221; want advertisement all across the country. Outside of Chicago an advertisement for a SAS programmer boldly states, &#8220;H-1b Holders Only&#8221;. Another advertisement is for an Entry Level job for foreign students &#8211; ONLY. A third advertises &#8220;Walk-in Interviews&#8221; for a job opening in New Jersey &#8211; but you must go to Pune, India to interview! Indian headhunters are recruiting abroad for K-12 teachers, cancer surgeons and real estate salespersons to work in the United States. An information technology staffing firm based in Rolling Meadows, Ill., posted an advertisement for a technical writer to work on projects for a Chinese client. The advertisment read &#8220;arrogant American(s)&#8221; need not apply.</p>
<p>In fact, American corporations, such as Amazon, McAfee, and Synapse Design, regularly hold job fairs in the Untied States but only foreigners are invited.</p>
<p>American college student are faced with employers who will only hire foreigners. The U.S. Government has established preferences for foreign students to get into a U.S based school and the gives them preferences to jobs while in college, through the OPT and/or CPT visas. Over 2,000 jobs for entry level college graduates can be found on the internet at any one time. Yet, more than half of those job opportunities are for foreigners ONLY.</p>
<p>The result is an inequality that is rapidly undermining democracy. Like an odorless gas, every corner of our country is being sapped of its strength. The evidence of the economic pollution is everywhere. As Bob Dole once said&#8221; The poor don&#8217;t contribute to campaign funds.&#8221; Our government is consistently favoring the rich. This is the sad source of the problem.</p>

<p>Computerworld &#8211; Eighteen IT workers in California have filed a lawsuit against their former employer claiming they were replaced by H-1B workers from India and then laid off in violation of the state&#8217;s anti-discrimination laws.</p>
<p>In the lawsuit, the 18 workers say that IT managers at Molina Healthcare Inc. increasingly catered to the Indian workers while leaving U.S. workers, mostly security analysts and programmers who earned at least $75,000 a year, feeling excluded prior getting laid off last year.</p>

<em>Speaking after the hearing, Issa said H-1B reform needs to happen, but he noted that it faces significant hurdles from congressional members such as Rep. Zoe Lofgren (D-Calif.), whose district includes San Jose, where Issa was speaking. He said Lofgren is holding high-end workers hostage for the low-skilled, illegal immigrant.&#8221;</em></p>

The complaint stated that Infosys had implied the maximum experience as 25 years, which De Vito already had while applying in August 2009.De Vito in his complaint said that , the requirements for the maximum experience constituted a limitation, specification or discrimination as to age i.e. a de facto age limit as they were vulnerable to eliminate applicants for the positions at Infosys who were older or more than forty.</em></p>
